The professor working at a university on the non-tenure track failed to meet the standard for renewal of contract and was refused renewal by the university. The professor sought an appeal for cancelation of the refusal of contract renewal from the committee, and the committee decided to cancel the refusal.
Jipyong represented the university to file an administrative lawsuit for the cancelation of the committee’s decision and won the case. The professor appealed. At the appellate court, Jipyong also represented the university and argued that the committee’s decision was unlawful as it mistakenly applied the standard for determining the contract renewal and the university’s initial assessment was lawful and correct.
Seoul High Court accepted these arguments and found that the committee’s decision was defective in mistakenly applying the standard for determining the contract renewal and that, considering the standard for determining the contract renewal, the committee’s decision was unlawful and should be canceled.
