Jipyong Successfully Co-Hosts Seminar on “Korea-Thailand Investment and Dispute Risk Management” with Kudun & Partners

<p style="text-align: justify;">On February 26, 2026, Jipyong co-hosted a seminar titled “Korea-Thailand Investment and Dispute Risk Management: From Contracting to Enforcement” with Kudun & Partners, a leading Thai law firm, at the Auditorium on the 3rd floor of Grand Central Building B at Jipyong's headquarters in Seoul.<br />

Moderated by Jipyong Foreign Attorney Jinhee KIM, the seminar featured four presentations designed to provide Korean companies–whether considering entry into or already operating in Thailand–with a deeper understanding of the Thai market and practical business strategies.<br />
<br />
Foreign Attorney Ki Il BAN, Head of Jipyong's Thailand Team, delivered the first presentation on “Overview of Thailand’s Legal and Business Environment and Investment Trends.”  Mr. BAN emphasized that “entering the Thai market requires a comprehensive review of key legal and regulatory frameworks, including Thailand’s Foreign Business Act and investment promotion schemes.  It is essential to analyze sector-specific regulations and develop strategies for leveraging investment incentives.”<br />

In the second session, Partner Chai Lertvittayachaikul of Kudun & Partners presented on “From Negotiation Strategy to Drafting Execution: How to Make Dispute Clauses Work in Real Life.”  He outlined critical factors to consider from negotiation through the drafting phase and provided guidance on structuring dispute resolution clauses.  “A contract is not merely a record of agreement, but a strategic instrument that pre-designs the outcome of potential disputes," he advised.  “Legal risks must be carefully controlled through precise language and structural safeguards.”<br />

Jipyong Foreign Attorney Somin K. JUN then presented on “Managing Legal Risks Through Contract Negotiations.”  Ms. JUN stressed that “during the contract negotiation phase, it is essential to meticulously design the structure of dispute resolution clauses and the choice of governing law and forum, while taking a strategic approach that considers the enforceability after a dispute arises.”<br />

The final presentation was delivered by Partner Kongwat Akaramanee of Kudun & Partners on “Resolving Commercial Disputes in Thailand.”  Mr. Akaramanee outlined Thailand’s litigation and arbitration systems and the framework for recognition and enforcement of foreign judgments and arbitral awards.  “Selecting the appropriate forum based on a comprehensive consideration of the nature of the dispute and its enforceability is the starting point for effective dispute resolution, he stated.”<br />
<br />
“As investment and trade between Korea and Thailand continue to expand, it is more important than ever to proactively design strategies for dispute prevention and response,” remarked Foreign Attorney Jinhee KIM.  “We hope this seminar provided companies with opportunity to evaluate the practical capabilities required in the international transaction environment.”</p>
