[Case Highlight 4] Successful representation at Supreme Court case appealing preliminary injunction as to decision of preliminary injunction for inspection and duplication of church account books

Jipyong represented members of church A to apply for a preliminary injunction for inspection and duplication of account books and documents against the church on the ground the former pastor was suspected of illegally using the church properties to obtain a successful verdict at the appellate level. The church refused to comply with the decision of preliminary injunction, and filed an appeal against the preliminary injunction to the appellate court. However, Jipyong successfully represented the member of the church A. Again, the church A appealed to the Supreme Court.

At the Supreme Court, Jipyong convincingly argued for the need of the members to inspect and duplicate the church account books on the following grounds: (i) the pastor was declared guilty of misappropriation of the church funds at the lower court decision; (ii) there was circumstantial evidence of disposal of church property without proper procedures; (iii) the construction project for the new church building was improperly granted to the company personally related to the pastor.

The Supreme Court accepted the arguments of Jipyong, and dismissed the appeal of the church A.
