The employees of a corporation claimed for relief at the Labor Relations Commission, arguing that the corporation’s assignment of performance review rating and the resulting salary determination constituted improper reduction of salary and unfair labor practice.
Jipyong represented the employer and argued that the performance review and the resulting salary determination followed fair and reasonable standards and procedures. In particular, Jipyong emphasized that the salary determination in the particular year to which the employees raised a claim was a matter which had been resolved by mediation of the National Labor Relations Commission and therefore this claim was not consistent with the result of the mediation in arguing for dismissal of the claim.
The Labor Relations Commission accepted the arguments of Jipyong, and dismissed the claim.
