The Labor Standards Act’s Current 12-Hour Overtime Limit: Interpretation and Ruling by Korea’s Highest Court

On December 7, 2023, the Supreme Court of Korea issued its first-ever ruling regarding the country’s 12-hour-overtime limit under Article 53(1) of the Labor Standards Act (LSA). The Supreme Court clarified that the 12-hour overtime limit under Article 53(1) shall be calculated against an employee’s hours worked in excess of 40 hours per week, irrespective of whether the employee’s daily overtime hours (hours worked in excess of 8 hours per day) total more than 12 hours per week.
