									<td height="35"><img alt="미국 재무부는 2016년 5월 17일(미국 현지시간) 미얀마에 대한 미국의 경제제재를 추가적으로 완화하는 조치를 하였습니다.   이는 2015년 11월 평화롭게 치러진 미얀마 대통령 선거와 이에 이어 정권이 민주적으로 이양됨에 따라 미국 정부가 미얀마의 정치적인 발전과 대대적인 경제성장을 위하여 취한 것으로 이해되고 있습니다.  아래에서는 최근 미국의 對미얀마 경제제재 완화 내용과 시사점을 살펴보도록 하겠습니다." height="199" src="/origin/newsletter_alert/160520/img/img_2.gif" width="664" /></td>

									<td align="left" height="32" valign="top"><img alt="1. 2016년 5월 17일 경제제재 완화 내용가. 미얀마 주요 은행에 대한 경제제재 완화 먼저 미국은 3개 국영은행인 미얀마경제은행(Myanma Economic Bank, MEB), 미얀마 외국무역은행(Myanmar Foreign Trade Bank, MFTB), 미얀마투자상업은행(Myanma Investment and Commercial Bank, MICB)을 특별지정 제재대상 목록(Specially Designated National List, 이하 특별지정 제재대상은 “SDN”, 특별지정 대상 목록은 “SDN List”이라 함) 에서 삭제했습니다.  이로써 미국인(미국 기업 포함, 이하 같음)이 위 3개 국영은행과 거래하는 것이 허용되었습니다. 또한, 인냐은행(Innwa Bank), 먀와디은행(Myawaddy Bank)은 SDN List에 남아 있기는 하나 동 은행들과의 대부분 거래를 허용하는 일반허가를 발급함으로써 (일부 제한은 있으나) 거래를 허용하였습니다.  이를 통하여 미국인이 위 은행들과 거래(계좌 개설, 예금, 예금 이체 등)하는 것이 가능해졌습니다. 나. 7개 국영기업에 대한 경제제재 완화 미국 재무부는 변화하는 미얀마 환경에 맞추어 미얀마에서 주요 부처들이 직접 출자하여 운영하는 7개의 국영기업(Myanmar Timber Enterprise, Myanmar Pearl Enterprise, Myanmar Gem Enterprise, No. 1 Mining Enterprise, No. 2 Mining Enterprise, No. 3 Mining Enterprise, Co-Operative Export-Import Enterprise)을 SDN List 에서 삭제함으로써 미국인이 동 국영기업들과 거래를 하는 것을 허용하였습니다. 									<td align="left" height="45" valign="top"><img alt="다. 임시로 적용되던 일반허가 20(General License 20)을 법규정화일반허가 20(General License 20) 은 ‘미국인이 상품, 기술, 비금융서비스를 미얀마로 수입하거나 미얀마에서 수출하는 거래에 부수하여 발생하는 무역관련 간접 금융거래(특히, 항만 이용료, 하역료 등 지급)’를 SDN 과 할 수 있도록 임시적으로(6개월) 허용하는 허가입니다(2016년 6월 7일 효력만료).   미국 재무부는 2016년 5월 17일 동 일반허가의 내용을 법규정화(31 C.F.R. § 537. 532(a))함으로써 그 효력이 지속될 수 있도록 조치하였습니다.  또한 미국 재무부는 2016년 5월 17일 미얀마 무역을 증진시키기 위하여 미얀마 내에서의 물류에 부수하는 일정한 거래(여기에는 물류창고와 리테일상점 사이의 물류가 포함됨)를 허용하는 일반허가를 추가로 발급하였습니다.   라. 미얀마 거주 미국 국적 개인의 개인적인 목적의 거래에 대한 규제 완화미국 재무부는 미얀마에 거주하는 미국 국적 개인의 거래에 대한 규제도 완화하였습니다. 이전까지 미국인들은 SDN과는 일절의 거래가 금지되었으나 앞으로 자유롭게 개인적인 목적의 거래(임차료 지급이나 생필품 구입 등)를 할 수 있을 것으로 예상됩니다.  마. 특별지정 제재대상 추가 지정 미국 재무부는 기존에 SDN List로 지정되어 있던 Steven Law와 Asia World가 50%이상 지분을 보유하거나 이들이 통제하고 있는 것으로 밝혀진 다음 회사들을 SDN List에 등재하였습니다.  - Asia Mega Link Co., Ltd., Asia Mega Link Services Co., Ltd., Pioneer Aerodrome Services Co., Ltd., Green Asia Services Co., Ltd., and Global World Insurance Company Limited. 									<td align="left" height="32" valign="top"><img alt="미얀마 재무부는 미얀마의 주요 국책은행인 미얀마경제은행(MEB), 미얀마외국무역은행(MFTB), 미얀마투자상업은행(MICB)을 SDN List에서 제외함으로써 미국인 사업가들의 미얀마에서 은행거래가 보다 자유로워질 것으로 예상하고 있습니다.  또한, 위 3개 국영은행뿐만 아니라 정부가 출자한 7개의 국영기업을 SDN List에서 제외함으로써 미국은 미얀마 정부의 활동에 대해서 기본적으로 신뢰의 메시지를 보내고 있어 향후 추가적인 제재 완화가 기대되고 있습니다. 반면, 대부분 제재 완화의 추세 속에서 오히려 SDN List 포함 대상이 늘어난 점도 눈 여겨 보아야 할 부분입니다.  SDN List에 직접 등재된 대상자들 뿐만 아니라 이들이 50% 이상 지분을 보유하거나 지배(control)하는 기업 등도 개념적으로 SDN List에 포함된 것으로 해석될 여지가 있는데, 이번 조치를 통해 이를 실제로 적용하고 있다는 점을 확인할 수 있습니다.  향후 미국 경제재제의 영향이 우려되는 투자나 거래를 하고자 하는 경우, 거래 상대방이 SDN List에 포함되어 있는지 뿐만 아니라 SDN List에 포함된 자에 의한 지배관계 여부도 확인이 필요할 것입니다. 한편, 미국의 은행은 여전히 미얀마 진출에 대해서 주저하는 것으로 보입니다.  미얀마의 주요 경제 부문이 여전히 군부 출신들이 장악하고 있고, 이들은 SDN일 가능성이 높기 때문입니다.  또한, 모든 거래에 있어서 상대방이 SDN인지 여부에 대하여 검토하여야 하는 업무부담도 크다고 합니다. 미국의 경제제재 내용이 미국인을 대상으로 한 것이어서 한국기업에 대해 직접적인 영향을 미치는 것은 아닙니다.  그러나 미국의 경제제재는 미국인(미국기업)의 미얀마 내 투자 범위에 영향을 미쳐 전반적인 미얀마 외국인투자의 지형에 변화를 가져올 수 있고, 달러화 거래와 같이 미국인 이외의 기업의 투자나 거래에도 간접적인 영향을 미칠 수 있어 지속적인 관심이 필요합니다." height="658" src="/origin/newsletter_alert/160520/img/img_5.gif" width="664" /></td>
