Preparation of Base Provisions for the Establishment of a Master Plan for Product Safety Management

- Enactment of the Enforcement Decree of the Framework Act on Product Safety - 
(Presidential Decree No. 22651, enforced as of February 5, 2011) 
 
1. The Minister of Knowledge Economy shall establish a master plan for product safety management by consulting with the heads of the relevant administrative agencies and by listening to the opinions of the Mayor/Do Governor and he must also notify the heads of the central administrative agencies and the Mayor/Do Governor of the above fact (Article 2). 
 
2. The heads of the central administrative agencies may, if it is necessary to investigate the safety of a product, request the Korea Product Safety Association, etc. to test or inspect the safety of the product, and inform any risk which has been confirmed as a result of the investigation thereof to the relevant business operator and the safety certification authority which certified the relevant product without delay (Article 4). 
 
3. "Material defect" for which the heads of the central administrative agencies may order the recall, etc. of a product is defined as a defect which caused or is likely to cause death or injury requiring treatment for four weeks or more, or a defect which may cause a fire (Article 10). 
 
4. Where the heads of the central administrative agencies recommend the recall of a product, etc. they shall do so in writing, in which the reasons for such recommendation should be included, and the business operator who has received the recommendation shall notify the heads of the central administrative agencies whether it will accept or refuse the recommendation within ten days from the receipt of recommendation (Article 6).
