Subcontract Law

The Fair Transactions in Subcontracting Act (the “Subcontracting Act”) regulates special unfair trade practices to protect the interests of subcontractors who are economically disadvantaged, by preventing the prime contractor’s abuse of its superior position in subcontracting. The statute is subject to differing interpretations and regular amendments. In addition, the Subcontracting Act is becoming more stringent, and new issues have emerged, including, for example, the supply price adjustment system and technology takeovers. For these reasons, regular risk management practices can be helpful, and, when issues do arise, we are the leading unfair trade specialists to deliver the best-possible outcomes for our clients.

Given our practical understanding of a broad spectrum of industries, Jipyong's Antitrust & Competition Group provides guidelines on contracts to prevent violations of the Subcontracting Act. Our attorneys bring successful results in defending our clients in KFTC investigations and court proceedings by taking a proactive and, when appropriate, novel approach to legal issues.
